What is Clarendon's "Guaranteed Build Time"?
- Clarendon is providing a guarantee that the building works will reach practical completion within 25 weeks from the Site Start date subject to the conditions below
- In the event that Clarendon fails to reach practical completion in accordance with the Contract and subject to the matters listed below within 25 weeks, the Owner will be entitled to claim liquidated damages in the sum of $300 per week
What homes does the "Guaranteed Build Time" apply to?
- Only applies to single storey homes
- Only applies to homes 30 squares and under (including garage)
When does the 25 week promotional building period commence?
The 25 week guaranteed building period commences in accordance with the Contract, that is, 20 working days after the builder has received all necessary building permits and planning approvals for the building works and the owner has complied with the requirements of Clause 45 relating to essential matters
What conditions apply to the 25 Week Guaranteed Build Time?
- Only applies if the home is built on the builder’s preferred siting on the site
- Only applies to face brickwork
- Only applies to standard design and specifications and lifestyle options
When does the 25 Week Guaranteed Build Time not apply?
- Does not apply to home sites with greater than 1m fall across the building area and/or where a waffle pod slab system is not being used and/or where rock excavation is required
- Does not apply to sites where buried material, artefacts, sewer and other underground services affect the building works
- Does not apply to some Geographical Areas - Area 11 & 12 (Refer to Area Allocation Zone Map)
- Does not apply to 2 Storey Homes or Split Level Home Designs
- Does not apply to demolition sites or homes where the use of a Traffic Management Plan is required
When is Clarendon entitled to claim extension of time?
- suspension of works due to a breach of the contract by owner
- the owner’s failure to make a payment on time
- inclement weather
- disputes with neighbours or residents
- civil commotion or industrial action
- anything done or not done by the owner or by an agent, contractor or employee of the owner
- a delay in getting any approval (not caused by the builder)
- industry shutdown period (4 weeks over Christmas and New Year)
- other Public Holidays
- any other cause beyond the reasonable control of the builder, including but not limited to a delay in the supply and/or availability of trades and/ or materials to the site
- any other extensions of time that Clarendon is entitle to claim under the contract
